Terms of Service

1. Acceptance of Terms
By accessing this website, booking an appointment, purchasing a service or digital product, or otherwise conducting business with NotarEaseNYC (Company, we, our, or us), you agree to be bound by these Terms of Service. If you do not agree, do not use our website or services.
2. Services Provided
NotarEaseNYC may provide Mobile Notary Services, Remote Online Notarization (RON), Apostille Processing, I-9 Employment Verification, Wedding Officiant Services, Document Facilitation, Digital Products, Educational Materials, and Administrative Services. NotarEaseNYC is not a law firm and does not provide legal, tax, immigration, or financial advice.
3. Identification Requirements
All signers must present valid, government-issued identification as required by applicable law. Identification must be current and unexpired, contain a photograph when required, and match the information presented by the signer. NotarEaseNYC reserves the right to refuse service if identification requirements are not met.
4. Credible Witnesses
Where permitted by law, a signer may use a credible witness. The credible witness must be legally qualified, possess valid unexpired government-issued identification, and be willing to provide any required oath or affirmation. NotarEaseNYC determines whether a credible witness satisfies applicable legal requirements.
5. Appointments, Rescheduling, and No-Shows
Clients who miss a scheduled appointment may reschedule one time within fourteen (14) calendar days of the original appointment date. After fourteen (14) days, the appointment shall be considered forfeited and a new booking and payment will be required. Failure to appear does not entitle the client to a refund.
6. Corrections Policy
If an error is caused directly by NotarEaseNYC during a notarization, a correction appointment may be provided. The client must provide clean replacement documents when necessary, valid identification, and any additional information required. Corrections do not include client-requested changes or modifications made after the original notarization.
7. Refund Policy
ALL SALES ARE FINAL. No refunds shall be provided for completed services, mobile notary, RON, apostille, wedding, or I-9 services, administrative services, digital or educational products, missed appointments, client errors, or government delays. Any exception is made solely at the discretion of NotarEaseNYC.
8. Mobile Notary Travel Fees
Travel fees are earned upon departure to the appointment location and are non-refundable. They remain due even if the signer is unavailable, arrives late, refuses to sign, lacks proper identification or required documents, changes their mind, or the notarization cannot be completed due to client-related issues.
9. Apostille Services
NotarEaseNYC facilitates apostille and authentication services but does not control any government agency. Processing times are estimates only and are never guaranteed. NotarEaseNYC is not responsible for delays caused by County Clerks, State or Federal Agencies, Embassies, Consulates, postal or shipping carriers, government closures, weather, or incomplete or incorrect documents. No refunds shall be issued due to government delays or document rejections.
10. Shipping and Delivery
Once documents are delivered to a shipping carrier, responsibility transfers to the carrier. NotarEaseNYC is not responsible for lost, delayed, or damaged shipments, delivery failures, or incorrect delivery addresses supplied by the client.
11. I-9 Verification Services
NotarEaseNYC may act as an Authorized Representative for Form I-9 when requested by an employer. NotarEaseNYC does not determine employment eligibility, provide immigration advice, guarantee employment approval, make hiring decisions, or interpret immigration laws.
12. Wedding Officiant Services
A valid marriage license is required before any ceremony, both parties must meet all legal requirements under New York law, and wedding dates are reserved exclusively once booked. All wedding deposits, retainers, reservation fees, and payments are non-refundable.
13. Client Responsibility for Documents
Clients are solely responsible for providing accurate information, bringing required documents, reviewing documents before signing, and confirming names, dates, and other information. NotarEaseNYC is not responsible for errors within documents prepared by clients, attorneys, online providers, employers, or third parties.
14. Refusal of Service
NotarEaseNYC reserves the right to refuse service when identification requirements are not met, fraud or coercion is suspected, a signer appears unwilling or impaired, or applicable laws prohibit the requested service. No refund is required when service is refused for legal, ethical, or safety reasons.
15. Chargebacks and Payment Disputes
Clients agree not to initiate chargebacks or payment disputes for services properly scheduled, reserved, initiated, delivered, partially performed, or completed. Before initiating a dispute, clients agree to contact NotarEaseNYC and provide a reasonable opportunity to resolve the issue. NotarEaseNYC reserves the right to contest all chargebacks using available evidence, including booking and payment records, signed agreements, terms acceptance logs, transaction records, appointment confirmations, communications, GPS and mileage logs, delivery confirmations, electronic journal entries, identity verification records, and recordings. Any fraudulent or bad-faith dispute may be contested to the fullest extent permitted by law.
16. Electronic Records and Consent
The client agrees that electronic signatures, records, emails, text messages, digital logs, recordings, website records, audit logs, and payment records may be used as evidence of consent, acceptance, and completion of services.
17. Limitation of Liability
To the fullest extent permitted by law, NotarEaseNYC shall not be liable for indirect, incidental, special, consequential, or punitive damages. Any liability shall be limited to the amount paid by the client for the specific service giving rise to the claim.
18. Force Majeure
NotarEaseNYC shall not be liable for delays or failures caused by events beyond reasonable control, including weather, natural disasters, power or internet outages, government actions, public emergencies, transportation disruptions, and acts of God.
19. Website Use
Users agree not to violate applicable laws, misrepresent their identity, attempt unauthorized access to systems, upload malicious content, or interfere with website operations.
20. Signer Representations and Warranties
By requesting any notarial or document service, you represent and warrant that: you are the person you claim to be; the identification you present is genuine, unaltered, current and lawfully issued to you; you are signing willingly and are not under duress, coercion or undue influence; you understand the document you are signing; you have the legal authority to sign in the capacity stated, including any representative, corporate, fiduciary or power-of-attorney capacity; the statements contained in your document are true and complete; and you are not signing or submitting any document for a fraudulent, deceptive or unlawful purpose.
These representations are made by you, not by NotarEaseNYC. We rely on them.
21. What a Notary Does and Does Not Verify
A notary public verifies the identity of the person appearing and witnesses the signature or administers the oath. A notary public does not verify, investigate, confirm, endorse or vouch for the truthfulness, accuracy, legality, completeness or enforceability of anything contained in a document.
NotarEaseNYC accepts documents and identification at face value, as presented. We do not conduct title searches, ownership investigations, background checks, authority verification, or forensic examination of identification beyond the credential analysis required by law. Nothing in a notarization should be understood by any person as an opinion, certification or assurance regarding the contents of the document, the ownership of any property, or the authority of any signer.
22. Fraud, Misrepresentation, and Reporting to Authorities
NotarEaseNYC has no involvement in, and will not knowingly participate in or facilitate, any fraudulent, deceptive or unlawful act.
We reserve the absolute right to refuse or discontinue any service, at any point and without refund of fees already earned, where we believe in good faith that: identification is false, altered or does not belong to the person presenting it; a signer lacks capacity or is being coerced; a signature is being made on behalf of an absent person; a document appears altered, incomplete, backdated or fabricated; or the transaction may involve fraud, elder abuse, identity theft, or any other unlawful purpose.
Suspected fraud will be reported. Where we have reason to believe a service request involves fraudulent or criminal activity, we may report the matter to the New York City Sheriff’s Office, the applicable District Attorney, the New York State Department of State, law enforcement, and any affected party, and we will cooperate fully with any resulting investigation.
As required by law, we maintain a notarial journal, records of identification presented, and, for remote online notarizations, an audio-visual recording of every session. These records may be produced to law enforcement, courts, regulators or other lawful authority pursuant to subpoena, court order or other lawful request, and, where the law so provides, without prior notice to you.
Any person who presents false identification, makes a false statement, or submits a fraudulent document to NotarEaseNYC assumes full and sole legal responsibility for that conduct and for all resulting consequences.
23. Document Recording, Deeds, and Deed Fraud
Where NotarEaseNYC submits documents for recording through ACRIS or any county clerk, we act solely as a ministerial filing agent. We prepare and transmit the documents you provide. We are not a title company, abstract company, escrow agent or law firm.
We do not verify ownership, chain of title, liens, encumbrances, boundary or survey matters, the validity of any signature obtained elsewhere, or any signer’s legal authority to convey, encumber or transfer an interest in real property. Recording is an administrative act. Recording a document does not make it valid, and does not transfer or confirm ownership of anything.
You represent and warrant that you have full lawful authority to record the document you submit, that every signature on it is genuine, and that it is not being recorded to defraud any person or to obtain, encumber or transfer an interest in property you do not lawfully hold.
The New York City Register reviews documents submitted for recording and refers suspicious filings to the Sheriff’s Office for investigation. NotarEaseNYC will refuse to submit, or will withdraw where possible, any document we believe in good faith may be fraudulent, and will report the matter to the appropriate authorities.
If you are a property owner: the City offers free protections and we encourage every client to use them. Enroll in the City Register’s Recorded Document Notification Program, which mails you a notice whenever a document is recorded against your property, and check your record on ACRIS at least once a year. If you believe you are a victim of deed fraud, act immediately: contact the New York City Sheriff’s Office at (718) 707-2100 or file online, obtain a certified copy of the fraudulent document, contact the District Attorney in the borough where the property is located, and consult an attorney. The City also operates an Office of Deed Theft Prevention that coordinates agencies, legal services and prosecutors on these cases.
24. Indemnification
You agree to indemnify, defend and hold harmless NotarEaseNYC, Safari Dehaney LLC, and their owners, officers, employees, contractors and agents from and against any and all claims, demands, actions, investigations, liabilities, losses, damages, fines, penalties, costs and expenses, including reasonable attorneys’ fees, arising out of or relating to: any breach of these Terms; any misrepresentation, false statement, false identification or omission by you or any person you present; the contents, preparation, execution, recording or use of any document you provide; any fraudulent, deceptive or unlawful act by you or any person acting on your behalf; any claim brought by a third party in connection with a service you requested; and any dispute regarding ownership, authority, capacity or entitlement relating to a document we notarized, processed or recorded.
This obligation survives completion of the service and any termination of these Terms.
25. Reliance and No Third-Party Beneficiary
Our services are provided to the requesting client only. No third party, including any recipient of a notarized or recorded document, may rely on NotarEaseNYC as having verified the contents of a document, the authority of a signer, or the validity of any transaction. A notarial certificate speaks only to the act of identification and signature described in it.
26. Changes to Terms
NotarEaseNYC reserves the right to modify these Terms at any time. Updated Terms become effective immediately upon posting to the website.
27. SMS / Text Messaging Program Terms
Program name: NotarEaseNYC Appointment & Service Alerts.
Description: By providing your phone number and checking the SMS consent box, you agree to receive text messages from NotarEaseNYC related to appointment confirmations, reminders, notarization status updates, digital signing links, and service-related notifications.
Message frequency: Message frequency varies based on your appointments and interactions with NotarEaseNYC, typically 1-5 messages per transaction.
