What a Notarization Actually Certifies
A notarial certificate confirms that a person appeared before the notary, was identified in the manner required by law, and signed or swore to the document. It certifies nothing else.
It is not a statement that the contents of the document are true, accurate, lawful or enforceable. It is not an approval of the transaction. It is not confirmation that the signer owns anything, is entitled to anything, or has authority to act for anyone. Any person receiving a notarized document should evaluate the document on its own merits and should not treat the notary’s seal as verification of what the document says.
Documents Are Accepted at Face Value
NotarEaseNYC accepts documents and identification as presented. We perform the identity verification and credential analysis required by law, and nothing further. We do not investigate ownership, authority, capacity, title, liens, family circumstances, or the accuracy of any statement in a document. We are not able to detect every form of sophisticated forgery, and we make no representation that we can.
No Involvement in Fraudulent Activity
NotarEaseNYC does not participate in, assist with, advise on or knowingly facilitate any fraudulent, deceptive or unlawful act. We refuse service where we believe in good faith that identification is false, a signer lacks capacity or is being coerced, a document has been altered or fabricated, or the purpose of the transaction may be unlawful.
Where we suspect fraud, elder abuse, identity theft or other criminal conduct, we report it to the New York City Sheriff’s Office, the applicable District Attorney, the New York State Department of State, or other appropriate authority, and we cooperate fully with any investigation. Our notarial journal, identification records and remote online notarization recordings may be produced under subpoena, court order or other lawful request.
Any person who presents false identification or a fraudulent document bears full and sole responsibility for that conduct.
Deed Recording and Deed Fraud
When NotarEaseNYC submits a document for recording through ACRIS or a county clerk, we act as a ministerial filing agent only. We are not a title company, abstract company or law firm. We do not verify ownership, chain of title, liens, encumbrances, survey matters, or a signer’s authority to convey or encumber real property. Recording a document does not make it valid and does not confer ownership.
Deed fraud is a serious crime, and seniors, immigrants and homeowners of color are disproportionately targeted. The New York City Register reviews submitted documents and refers suspicious filings to the Sheriff’s Office. We will refuse or withdraw any submission we believe may be fraudulent and will report it.
Every property owner should take two free steps. Enrol in the City Register’s Recorded Document Notification Program, which mails you a notice whenever anything is recorded against your property, and check your own record on ACRIS at least once a year. Both are available through the City’s deed fraud prevention page.
If you believe you are a victim: report it to the New York City Sheriff’s Office at (718) 707-2100 or online without delay, obtain a certified copy of the fraudulent document through ACRIS, notify the District Attorney in the borough where the property sits, and consult an attorney about confirming your ownership. The City also operates an Office of Deed Theft Prevention which coordinates agencies, legal services and prosecutors on these cases.
